The European agenda on disinformation: an area of supranational action with a significant impact on highly regulated sectors

Abstract:
The last legislature of the European Parliament was marked by three very clear regulatory priorities. On the one hand, as a priority, the economic and social recovery after the Covid-19 pandemic. On the other hand, from this framework regulation, a set of provisions of enormous significance for the future of European integration was passed, among which the legislation on environment and on the technological sector stands out. Despite the efforts promoted by the European institutions- significantly the European Parliament and the European Commission - to adopt instruments such as the Digital Services Law, the Digital Market Law, The 2022 Code of Practice on Disinformation or the package for the defence of democracy, the effect on the rights of citizens and the competitiveness of tech companies is objectionable. The aim of my proposal is to delve into the evaluation of EU policies to tackle disinformation in Member States. To this end, I will analyze whether the directives and regulations have had the expected results, I will examine the main drawbacks for their application to be really effective and what are the challenges to be addressed in the coming years -voluntariness of regulation, overlapping of European and national regulations, lack of control and supervisory bodies-. Finally, I will reflect on the impact they have had on issues such as the environment and the holding of elections.
